On motion of Mr. Goodyear, Resolved, That the commitiee on banks and incorporaiions be instructed lo enquire intp the epediency of passing a general law in relaiion to plank roads, so that they may be made without special acts of incorporation. In the Sknate, Feb. 10. The bill relative to the construction of mili dams was debated by Messrs. Balch, Dentón, Lathrop, Parsons, Eldredge, McReynolds, Green and others. The bill constitates the county surveyor, county judge and judge of probate, commissioners to allow the erection of dom, hear complaints, Scc. The damages for flowing &c. to be assessed by a jury if the partiescannot agree. In the House, the location of the cnpital was diseussed. The joint resolution proposing an amendment of the Constitution by striking out of sec 2, article 2, the word white, was read a third time and passed by yeas 35, nays 28. Yeas - Messrs. Adam, Brooks, Chubb, Clark, Davidson, Dyckman, Edmunds, Faxon, Fralic, Glen, Goodell, Goodwin, Goodyear, Harri, Haydon, Harrington, Jennings, Johnson, Kelsey,Kilborn, Lomis, McGraw, Miller, G. W. Moore, H. Mower, O'Malley, D. Pierce,J. D. Pierce, Renwick, Seeley, Seymour, Shook, H. W. Taylor, Upton, Speaker- 35. Nays - Arzeno, Barker, Bell, Britain, Brown, Coates, Culver, Darrah, Deming, Driggs, Eaton, Ferrington, Goodrich, Heberd, Hollister, Jones, Kinney,Knight, Makley, Marantette, McFcrlan, Pond, Pierce, C. H. Taylor, Throop, Turner, Walker- 28. . Mr. Juhnson moved a re-considerntion of the vote - he did not believe it to be the duty of the House to make the proposition, every member knew it was not called for by the people. It was within the knowledge of every man that no such provisión in our constitution een be adopted. It may be true that a smallHoto of tbe people nre anxious that ii should be adopted, 'out js that a reason ihal the House should adopt it. If we pa tb's resolution we adopt the measure virtually; it will bo considered that this House is in favor of the amendment. ] donot believo (said Mr. JJ that such i the case. I believe if it depended on our vote, a large majority would be opposed to the measure, but it is proposed out of deference to a few clnmorous individuáis who do t for effect. I do not impeach iheir motives but believe they would not vote forit if they thoughtthey couldcarry it. There was not one-fifth of the people ïh favor of such an amendment to the constitution, then what use in tampering with the constitution. It is nn instrument that oughtto be held in respect and not t rifled with. The people do not cnll for this resolution and they will not adopt it. Mr. J. D. Pierce said he voted for the resolution with the same views that the convention of New York submitted the r}uestion to the people. It is said to be Jemandod, and I am willing to leave.it io the people. I am opposed to the measure individually, but willing that it should be submhted to the people to decide for ihemselves. Mr. Hay don hoped it would notbe reconsidered - it was democratie and in accordance with the spirit of the nge. Mr. Throop said we should approach he constitution with more consideraron. The constitución requires that a majority ihall agree to the proposition, but does a majority of the House agree to this! Mr. Goodwin said so fnr as he knew the arguments were, that we may get rid of being vexed by petitions from the people on the subjeel - in order to put a quietus on the clamors of the people, we should pass this resolution thougli we do not ogree to it ourselves. Mr. Goodrich. The party who hare sent these petitions it is understood are about to dissolve and return to their original elementa. That should induce the Legislature not to assent to this vote. - The Legislature will be placed in a ridiculous light to aend to the people what thevdo not approve. The motion to roconsider prevailed, yeas 34, nays 28. The resoïution was recommitted. The bilí to lócate the seat of governnent at Lansing, Ingham co. passed the iïousc by the following vote : Yeas - Adam, Barker, Bell, Brooks, Brown, Coates. Culver, Deming, Driggs, Dyckman, Eaton, Fnxon, Ferrington, FValick, G!en, Goodrich, Hebbard, Hnrington, HolHster, Jennings, Johnson, fones, Kclsey, Kilborn, Kinne, Knight, Lomis, Makley, McFarlan, McGraw, Miller, G.
